Lawsuit Filed Against Income Tax Measure
Lawsuit alleges income tax reduction measures violates state Constitution
By Rick Green
An Oklahoma City attorney has filed a lawsuit against Gov. Mary Fallin, alleging an income tax reduction measure approved by the Oklahoma Legislature violates the state’s constitution on procedural grounds.
Jerry Fent, who has successfully sued the state before, contends in the lawsuit that bills affecting state revenue need to originate in the House, and this bill started in the Senate. He also says such bills require a three-fourths vote of lawmakers, and the approval of this bill did not reach that threshold.
Fallin’s office had no immediate comment.
